Rubbish Removal Canary Wharf Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Canary Wharf supplies rubbish removal and waste collection services. By booking a collection, you agree to be bound by these terms. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, company or organisation that requests or receives services from Rubbish Removal Canary Wharf.

Services means any rubbish removal, waste clearance, bulky waste collection, or related services provided by Rubbish Removal Canary Wharf.

Waste means rubbish, refuse and items presented by the Customer for collection as part of the Services, excluding any prohibited or hazardous materials, unless expressly agreed in writing.

Agreement means the contract between the Customer and Rubbish Removal Canary Wharf made up of these Terms and Conditions, the booking confirmation and any agreed written variations.

2. Scope of Services

Rubbish Removal Canary Wharf provides rubbish removal and waste collection services for domestic and commercial customers. The specific scope of the Services for each booking, including the type and approximate volume of waste, access requirements and collection date, will be agreed at the time of booking and confirmed in writing where practicable.

All Services are subject to availability and to the Customer providing accurate information about the waste, the property and any special access or parking requirements. The Company reserves the right to refuse or suspend Services if it considers that a job cannot be carried out safely, legally or as originally described.

3. Booking Process

3.1 A booking may be requested by telephone, email or online enquiry. The Customer must provide clear and accurate information about the waste to be removed, including:

a. the approximate volume or number of items;

b. the type of materials, including any electrical items or bulky furniture;

c. the floor level and access arrangements, including lifts, stairs and any access restrictions;

d. any time constraints or parking restrictions that may affect the collection.

3.2 Rubbish Removal Canary Wharf may request photographs or further information before confirming a quotation or appointment time.

3.3 A booking is only confirmed when the Customer accepts the quotation provided and an appointment date and time window has been agreed. The Company reserves the right to vary or withdraw a quotation if the booking is not confirmed within the period specified at the time of issuing the quotation.

3.4 The Customer acknowledges that any quotation given prior to attendance at the property is an estimate based on the information supplied. The final price may be adjusted on site if the actual volume, weight, type of waste or access conditions differ from those described at the time of booking.

4. Price and Payment

4.1 Prices for the Services will be quoted based on factors including but not limited to volume of waste, type of materials, access requirements, labour involved and disposal costs.

4.2 Unless otherwise stated, all prices are inclusive of standard disposal charges but exclusive of any additional fees for restricted or specialist items, such as certain electrical goods, mattresses or items requiring special handling.

4.3 Payment terms will be notified at the time of booking. Unless otherwise agreed in writing:

a. domestic customers must make payment in full on completion of the collection; and

b. commercial customers must make payment either on completion or in accordance with agreed account terms.

4.4 Payment may be made by cash, debit card, credit card, bank transfer or other method agreed by the Company. The Company reserves the right to request full or partial payment in advance, especially for large collections or commercial work.

4.5 If the Customer fails to make payment when due, Rubbish Removal Canary Wharf may suspend further services, charge interest on overdue amounts at the statutory rate and recover all reasonable costs incurred in pursuing the outstanding debt.

5. Cancellations and Amendments

5.1 The Customer may cancel or amend a booking by giving reasonable notice before the agreed arrival time.

5.2 Domestic customers may cancel a booking without charge by giving at least 24 hours notice before the agreed arrival window. If less than 24 hours notice is given, the Company reserves the right to charge a late cancellation fee, which may be up to a reasonable proportion of the estimated job value to cover wasted travel and labour costs.

5.3 Commercial customers must provide at least 48 hours notice to cancel or significantly amend a booking. If less notice is given, a cancellation charge may apply.

5.4 If the Customer is not present at the property at the agreed time, or is unable to provide access, or the waste is not available for collection as described, this may be treated as a late cancellation and a call-out charge may be applied.

5.5 Rubbish Removal Canary Wharf reserves the right to cancel or reschedule a booking at any time for reasons including but not limited to adverse weather, vehicle breakdown, staff illness, safety concerns or circumstances beyond its reasonable control. In such cases, the Company will use reasonable endeavours to notify the Customer as soon as practicable and to offer an alternative appointment. The Company will not be liable for any loss of profit, loss of business or consequential loss arising from such cancellation or rescheduling.

6. Customer Obligations

6.1 The Customer is responsible for:

a. providing accurate and complete information about the waste and the property at the time of booking;

b. ensuring that access to the waste is safe, unobstructed and suitable for the Companys vehicles and staff;

c. securing any necessary permissions for access, loading and parking, including any permits required by building management or local authorities;

d. ensuring that waste presented for collection does not contain prohibited items, hazardous materials or substances that are not disclosed or agreed in advance.

6.2 The Customer must not include in the waste any clinical, medical or biological waste, asbestos, gas bottles, explosives, corrosive substances, radioactive materials, liquid chemicals or any other items that are classified as hazardous under applicable waste regulations, unless expressly agreed in writing.

6.3 The Customer will indemnify Rubbish Removal Canary Wharf against any fines, penalties, claims, losses or expenses arising from the Customers failure to comply with waste regulations, from incorrect descriptions of waste, or from presenting prohibited materials for collection.

7. Performance of the Services

7.1 The Company will use reasonable skill and care in providing the Services. Collection times are given as estimates within a time window. While the Company will use reasonable endeavours to attend within that window, it cannot guarantee exact arrival times.

7.2 The Companys staff will collect waste from within properties or from external areas by prior arrangement. The Customer acknowledges that some movement of items and minor disturbance may be unavoidable when carrying out the Services.

7.3 The Customer must identify any fragile areas, delicate surfaces, vulnerable fixtures or special risks before the work starts. The Company may decline to remove items where it believes there is a significant risk of damage that cannot reasonably be mitigated.

8. Waste Handling and Regulations

8.1 Rubbish Removal Canary Wharf operates in accordance with applicable UK waste management legislation and guidance. Waste collected is transported to licensed facilities for recycling, recovery, reuse or disposal as appropriate.

8.2 By engaging the Services, the Customer authorises the Company to remove, transport and dispose of the waste on its behalf in compliance with relevant duty of care obligations.

8.3 On request, and where required by law, the Company may provide documentation relating to the transfer and disposal of waste, such as a waste transfer note, for commercial customers.

8.4 The Company reserves the right to refuse to collect any waste that it believes may contravene waste legislation, present a safety risk, or differ materially from the description given at the time of booking.

9. Liability and Damage

9.1 Nothing in these Terms and Conditions limits or excludes the Companys liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited by law.

9.2 Subject to the above, the Companys total liability to the Customer in respect of all other losses arising under or in connection with the Agreement, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total price paid or payable by the Customer for the relevant Services.

9.3 The Company will take reasonable care when providing the Services. The Customer must report any alleged damage to property in writing as soon as reasonably practicable and in any event within 48 hours of completion of the collection. The Customer must provide reasonable evidence of the damage and allow the Company a reasonable opportunity to inspect and, if appropriate, remedy the issue.

9.4 The Company will not be liable for:

a. pre-existing damage or defects;

b. fair wear and tear or damage that is reasonably unavoidable in the normal course of moving bulky items;

c. losses arising from inaccurate or incomplete information provided by the Customer;

d. any indirect, special or consequential loss, loss of profits, loss of business, or loss of opportunity.

10. Delays and Events Beyond Control

10.1 The Company will not be in breach of the Agreement or liable for delay in performing, or failure to perform, any of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control. These may include traffic congestion, road closures, extreme weather, accidents, breakdowns, strikes, acts of government or other similar events.

10.2 In such circumstances, the Company will use reasonable endeavours to contact the Customer and to perform the Services as soon as reasonably practicable.

11. Insurance

Rubbish Removal Canary Wharf maintains appropriate insurance cover for its operations, including public liability insurance. Details of cover can be provided on reasonable request.

12. Complaints

If the Customer is dissatisfied with the Services, they should notify the Company as soon as possible, giving full details of the issue. The Company will investigate the complaint and aim to resolve it promptly. The Customer agrees to give the Company a reasonable opportunity to address any concerns before taking further action.

13. Privacy and Data

The Company will collect and use personal data provided by the Customer for the purposes of managing bookings, providing Services, processing payments and meeting legal obligations. Customer information will be handled in accordance with applicable data protection laws. The Customer is responsible for ensuring that contact details are accurate and up to date.

14. Variation of Terms

The Company may update these Terms and Conditions from time to time. The version in force at the time of the booking will apply to that booking. A copy of the current Terms and Conditions will be made available on request.

15. Severance

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by any court or competent authority, that provision shall be removed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16. No Waiver

No failure or delay by the Company to exercise any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

Both the Customer and Rubbish Removal Canary Wharf agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services or the Agreement.

18. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Customer and Rubbish Removal Canary Wharf in relation to the Services. The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these documents.
